Terms & Conditions

These General Terms and Conditions (GTC) govern the use of the "susu" platform by users and businesses. They are binding and based on German law, in particular the German Civil Code (BGB) and the General Data Protection Regulation (GDPR).

1. Provider and Scope

  • Provider: susu GmbH, Irenenstr 66, 40468 Düsseldorf, Germany
  • Scope: These GTC apply to all users (businesses, customers) of the platform and its services, regardless of the means of access. Deviating user conditions are not recognized unless we expressly agree to them.

2. Terms of Use

  • Costs: Basic use (e.g., creating up to 5 menus, 2 media uploads) is free of charge. Premium features (e.g., unlimited menus, AR/VR) require a separate payment, the terms of which will be communicated before the contract is concluded. Prices are subject to change; existing users will be notified 30 days in advance.
  • Registration: Use requires registration with valid data. False information entitles us to immediate termination.
  • Technical Requirements: Users need a stable internet connection and compatible devices (e.g., current browsers). We are not responsible for failures due to inadequate technology.
  • Pre-purchase Information: When concluding a contract (e.g., a premium subscription), users are informed in advance about these GTC, the right of withdrawal, and possible exceptions. Confirmation of acknowledgement (e.g., a checkbox: "I have read the GTC and the right of withdrawal") is required before the contract becomes valid.

3. Services and Obligations

  • Services: We offer a platform for creating, managing, and publishing digital menus with an ordering function. Guarantees of availability (e.g., 99% uptime) apply only to premium users.
  • User Obligations: Users agree to use the platform lawfully, not to upload copyrighted content, and to comply with our privacy policy.

4. Limitation of Liability

  • Principle: susu GmbH is only liable for intent and gross negligence. For slight negligence, we are only liable for breach of essential contractual obligations (cardinal duties).
  • Amount of Liability: Claims for damages are limited to the amount of fees paid in the last 12 months, unless statutory provisions (e.g., product liability) state otherwise.
  • Exclusions: No liability for indirect damages (e.g., loss of revenue) or data loss due to user error, provided we offer regular backups (premium users).
  • External Content: We assume no liability for links to third-party providers.

5. Termination and Contract Duration

  • Duration: Use begins with registration and ends with termination. Free users can terminate at any time; premium contracts have a minimum term of 30 days.
  • Notice Period: 14 days to the end of the month, in writing (email or post) to info@susumenu.com.
  • Consequences: After termination, data will be deleted in accordance with the privacy policy, unless there is a legal retention obligation (e.g., 10 years for tax purposes).

6. Right of Withdrawal

<strong>Right of Withdrawal:</strong> You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day the contract is concluded. To exercise your right of withdrawal, you must inform us (susu GmbH, Irenenstr 66, 40468 Düsseldorf, Germany, Email: info@susumenu.com, Phone: +49 15906467215) of your decision by means of a clear statement (e.g., a letter sent by post, fax, or email). You can use the model withdrawal form below, but it is not mandatory. The deadline is met if you send the notification of the exercise of the right of withdrawal before the fourteen-day period has expired.

<strong>Consequences of Withdrawal:</strong> If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than fourteen days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.

<strong>Exclusion of the Right of Withdrawal:</strong> The right of withdrawal expires prematurely if the performance of the service has begun with your express consent and you have acknowledged before the conclusion of the contract that you lose your right of withdrawal upon full performance of the contract. This applies to digital content (e.g., premium subscriptions) that is not supplied on a physical medium as soon as we have begun with the performance of the service (according to § 356 para. 5 BGB). Your consent will be obtained in the purchase process through a clear option (e.g., a checkbox: "I consent to the service starting immediately and acknowledge that I lose my right of withdrawal upon full performance"), which you must actively confirm before concluding the contract.

7. Changes to the GTC

We reserve the right to adapt the GTC in the event of changes to the legal situation or our services. Changes will be published at https://www.susumenu.com/terms at least 30 days before they take effect and communicated to users by email. Silence is deemed to be consent unless an objection is made within 14 days.

8. Final Provisions

  • Written Form: Changes or additions to these GTC must be in writing.
  • Choice of Law: German law applies, excluding the UN Convention on Contracts for the International Sale of Goods.
  • Jurisdiction: The place of jurisdiction is Düsseldorf, if legally permissible (e.g., for merchants).
  • Severability Clause: Should any clause be ineffective, the remaining ones shall remain valid. An ineffective clause will be replaced by a legally effective one that comes closest to the purpose.
